Supreme Court to rule on Zanetor’s case on May 19

The Supreme Court will rule on the application filed by the National Democratic Congress’ (NDC) parliamentary nominee for Klottey Korle, Dr. Zanetor Rawlings over her candidature on May 19, 2016.
She is challenging the capacity of a High Court hearing the case in which her candidature is being contested.
This follows an adjournment last week due to the unavailability of the judges empanelled to hear the case
The incumbent Member of Parliament for the area, Nii Armah Ashietey, is in court challenging her eligibility to contest in the party’s primary held in November last year.
According to him, Dr. Zanetor Rawlings did not qualify to be elected as the parliamentary nominee, since at the time of the primary; she was not a registered voter.
This he said, is a serious constitutional breach but lawyers for Dr. Rawlings, believe the High Court is not the appropriate forum to adjudicate the matter.
She is thus seeking a restraining order to stop the judge from hearing her case at a High Court.
The writ filed by lawyers of Dr. Rawlings is seeking “an order of prohibition directed to the His Lordship Kwaku T. Ackah Boafo of the High Court…restraining him from proceeding to hear the dispute between the applicant and the interested parties pending a decision in the instant application.”
Dr. Zanetor has subsequently registered as voter ahead of the November 7 polls but lawyers of incumbent Nii Armah Ashietey say that will not exonerate her.
