We’re grateful to the Supreme Court-GIBA

The Ghana Independent Broadcasters Association (GIBA) has expressed gratitude to the Supreme Court for placing an injunction on the implementation of the new law requiring media owners to seek content approval from the National Media Commission (NMC) before publication.

The Ghana Independent Broadcasters Association (GIBA) filed a suit at the Supreme Court to strike out the Content Standards Regulation 2015, arguing that some aspect of the regulations are inconsistent with the 1992 Constitution which guarantees unfettered media freedom.

The new L.I empowers the NMC to grant content authorization to an electronic operator or revoke same if it goes contrary to the L.I.

The Content Standards Regulation 2015 also entreats all radio and television stations to seek content authorization from the NMC before airing a particular programme or in default pay a fine or serve between two and five years in jail

Speaking to Oman News in an interview President of GIBA, Mr. Akwasi Agyeman stated that “What we’re seeking for is an injunction and that is what the court has granted. So we are very grateful to the court.”

According to him, they are not done yet because they have to deal with the substantive case.

Mr. Akwasi Agyeman said they will continue engagement with the NMC in order to expunge some aspects of the LI, which they consider very grievous.
